1. Acceptance of these Terms
These Terms & Conditions (“Terms”) apply to your use of our website and to every podcast, video or brand service offered by Kamao Aur Kamane Do (“we”, “us”, “our”), operated by [Legal business name, e.g. Proprietor / Pvt Ltd], Mumbai, Maharashtra, India.
By using this website, applying to be a podcast guest, or paying for any service, you (“you”, “Guest” or “Brand”) agree to these Terms. If you do not agree, please do not use our website or services.
2. What we offer
Kamao Aur Kamane Do is a Hindi podcast and YouTube channel for founders and business owners, covering business ideas, franchise, distributorship, startups, B2B and growth mindset. Our services include:
- Podcast Package: a full-length podcast recorded at our studio in Mumbai with a professional multi-camera shoot and editing, publishing on our YouTube channel, promotion across our social media, and 7 repurposed shorts made from your podcast.
- Brand partnerships: dedicated videos, brand integrations and shorts, as agreed with you in writing.
What is included in your package is the scope confirmed with you by our team before payment. Anything outside that scope is a separate service.
3. Applying and selection
Applying through “Work with Us”, email or WhatsApp does not guarantee a recording. Our team reviews every application, and the topic, date and package are finalised together with you. We may accept or decline any application at our discretion, including where the topic or business does not suit our audience or channel.
4. Pricing and payment
- The price is the one confirmed to you in writing (for example on WhatsApp or email) at the time of booking. Offers such as the limited-time package price on our website can change or end without notice.
- Prices are [inclusive / exclusive] of GST and other applicable taxes.
- Payment terms: [e.g. 50% advance to confirm the date, balance before the recording day / full payment in advance].
- Your slot is confirmed only after we receive payment and send you a confirmation.
- Payments are made only through the payment methods and accounts shared by our official team. Please verify details with us before paying; we are not responsible for payments made to any other person or account.
5. Scheduling, rescheduling and cancellation
- The recording date is fixed with you in advance. Please arrive on time with the people who will appear in the episode.
- You may reschedule once, with at least [number] days’ notice, subject to our studio availability.
- If you cancel or do not show up without notice, we may treat the slot as used. Late rescheduling may attract a fee of [amount or %].
- We may reschedule or cancel a recording because of studio, team or technical issues, or situations beyond our control. In that case we will offer a new date or a refund as set out below.
6. Refunds
- If we cancel and cannot offer a suitable new date, you get a full refund of the amount paid for that service.
- If you cancel [number] days or more before the recording date, we will refund [e.g. amount paid less processing charges].
- Once the recording has taken place or editing has started, the fee is non-refundable, because the studio, crew and post-production time has been used.
- Approved refunds are made to the original payment method within [e.g. 7–10] working days.
7. Your responsibilities
You confirm that:
- the information you give us about yourself and your business is true and not misleading;
- everything you say, show or claim in the episode, including business models, earnings, investment or franchise figures and testimonials, is accurate and can be supported if asked;
- you have the right to use any logo, material, music, images or third-party content you bring to the recording;
- you will not make unlawful, defamatory, abusive or misleading statements, or promise guaranteed returns or income.
We may stop a recording or decline to publish content that breaks these rules or the law.
8. Editorial control and publishing
We keep full editorial control over the final edit, title, thumbnail, description, publishing date and promotion, so that the content suits our channel and audience. We will take reasonable care to represent you fairly. Unless agreed in writing, the guest does not get approval rights over the final edit. We do not guarantee any number of views, subscribers, reach, leads, enquiries, sales or business results from an episode or promotion. Figures shown on our website (for example subscribers or organic reach) describe the channel overall and are not a promise of results for any guest or brand.
9. Content ownership and licence
- The recording, edits, shorts, thumbnails and all other content we produce are owned by Kamao Aur Kamane Do and published on our channels.
- You give us a worldwide, non-exclusive, royalty-free licence, for as long as the content stays on our channels, to use your name, voice, image, likeness, business name, logo and the information you share in the episode, shorts and our promotion across YouTube and social media.
- You keep ownership of your own trademarks, logos and materials.
- You may share the published episode or shorts on your own channels by linking or reposting them with credit to Kamao Aur Kamane Do. Any other commercial use, such as running the episode as a paid ad, needs our written permission.
10. Brand partnerships and dedicated videos
Dedicated videos, integrations and shorts are covered by the scope, timeline and price confirmed in writing with you. Sponsored or paid content will be disclosed as required by applicable advertising and influencer disclosure rules in India. Brands remain responsible for the claims they make about their products and services.
11. Takedown requests
If you want published content removed or changed, write to us at the email below with the reason. We will review each request fairly and respond within a reasonable time. We are not required to remove content that is accurate, was recorded with your consent, or that you agreed to publish, and fees already paid are not refunded.
12. No professional advice
Our episodes, shorts and website share business ideas, franchise and distributorship opportunities and personal experiences for information and inspiration only. They are not financial, investment, legal, tax or business advice. Please do your own research and take professional advice before you invest in, buy into or partner with any business. We do not endorse or guarantee any business, franchise or opportunity featured on the channel.
13. Using our website
You agree not to misuse the website, including copying or scraping its content, trying to break or overload it, uploading harmful code, or using it for unlawful purposes. Content on this website is protected by copyright and may not be reused without our permission. Our website may link to third-party platforms (such as YouTube, Instagram and WhatsApp), which have their own terms and policies that we do not control.
14. Disclaimer and limitation of liability
We provide our services with reasonable skill and care, but to the extent allowed by law we do not give any other warranty. We are not liable for indirect or consequential loss, loss of profits, business or reputation, or for the actions of third parties and platforms. Our total liability for any claim relating to a service is limited to the amount you paid us for that service. Nothing in these Terms limits any liability that cannot be limited under Indian law.
15. Indemnity
You agree to compensate us for any loss, claim or legal cost arising from your breach of these Terms, from false or unlawful statements you make in an episode, or from material you give us that infringes someone else’s rights.
16. Events beyond our control
We are not responsible for delay or failure caused by events beyond our reasonable control, such as natural disasters, power or internet failure, government orders, strikes, platform outages or illness. We will work with you to reschedule or find a fair solution.
17. Privacy
How we collect and use your personal information is explained in our Privacy Policy, which forms part of these Terms.
18. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new “last updated” date. Changes apply from the date they are posted and do not affect a booking already confirmed in writing, unless the law requires it.
19. Governing law and disputes
These Terms are governed by the laws of India. We prefer to solve any disagreement through discussion first. If it cannot be resolved, the courts at Mumbai, Maharashtra will have exclusive jurisdiction.
